Terms of Service

These Terms govern your use of the Union Performance Training app (the "App"), provided by Union Performance LLC ("Union Performance," "UP," "we," "us"). By creating an account or using the App, you agree to these Terms and our Privacy Policy, including the health, safety and release terms in section 8.

1. What the App is

The App provides general workout programming: weekly workouts, exercise video demonstrations, and mobility routines. The programming is the same for all subscribers. It is not individualized coaching, medical advice, physical therapy, or a diagnosis or treatment of any condition.

2. Eligibility

You must be at least 18 years old to create an account. You must provide accurate information and keep your login details private. You are responsible for activity on your account.

3. Memberships and access

  • Paid subscription: $25 per month, billed in advance on a recurring monthly basis until you cancel.
  • Complimentary access: members of Union Performance's gym locations may receive access at no charge while their gym membership is active. Complimentary access ends when the gym membership ends.
  • We may change the price with at least 30 days' notice by email. The new price applies from your next billing date after the notice period.

4. Billing

Payments are processed by Stripe. We do not store your full card number. By subscribing, you authorize us to charge your payment method each month until you cancel. If a payment fails, we may retry it and may suspend access until payment succeeds.

5. Cancellation and refunds

  • Cancel anytime from the Profile page in the App ("Manage subscription"), or by emailing up@unionperformance.us.
  • When you cancel, you will not be charged again. You keep access through the end of the billing month you have already paid for.
  • No refunds or credits for partial months, unless required by law.

6. Acceptable use

You agree not to share your login with others, copy, download, record, resell or redistribute the App's workouts or videos, or attempt to access parts of the App you are not authorized to use. We may suspend or end accounts that break these Terms.

7. Our content

All workouts, programming, videos, text, logos and designs in the App belong to Union Performance or its licensors. Your subscription gives you a personal, non-transferable right to use them for your own training while your access is active.

8. Health, safety and release

  • Talk to your doctor before starting any exercise program, especially if you are pregnant, recovering from injury or surgery, or have a heart, joint or other medical condition.
  • You train on your own, without supervision. You are responsible for your surroundings, your equipment, and choosing weights and movements that suit your ability.
  • Exercise carries a risk of injury, including strains, sprains and falls, and in rare cases serious injury or death. You understand these risks and voluntarily accept them.
  • Stop and seek medical help if you feel pain, dizziness, chest discomfort or shortness of breath.
  • Nothing in the App is medical advice.

To the fullest extent permitted by law, you release Union Performance LLC, its owners, coaches, employees and contractors from, and agree not to sue them for, any injury, illness, loss or damage arising from your use of the App or its workouts, including claims based on their ordinary negligence. This does not apply to gross negligence or intentional misconduct.

9. Availability

We work to keep the App available, but we do not guarantee uninterrupted access. We may change, add or remove features or content at any time.

10. Disclaimers and limitation of liability

The App is provided "as is" and "as available." To the fullest extent permitted by law, Union Performance is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the claim.

11. Ending your access

You may stop using the App and cancel at any time. We may suspend or end your access if you break these Terms, with or without notice.

12. Governing law

These Terms are governed by the laws of the State of Oklahoma. Any dispute will be brought in the state or federal courts located in Oklahoma County, Oklahoma.

13. Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or in the App before it takes effect. Continuing to use the App after the effective date means you accept the updated Terms.
